Apple sued due to overheating of the iPad tablet, wins the first round

Apple was recently given in judgment by several customers dissatisfied with the fact that their iPad tablet was overheating during normal use. The case is old, it dates back to July 2010 and is based on the fact that an iPad tablet used outside during a hot day heats up too much, displays the message in the image above and shuts down until the entire system cools down. A federal judge in the US has decided to dismiss this case because the plaintiffs' complaints are not based on a legal basis. The plaintiffs argued that Apple lies when promoting the iPad tablet and that it sells defective tablets unable to function under normal conditions of use.

"The Court concludes that these allegations are insufficient," Fogel wrote in his order. "At the least, Plaintiffs must identify the particular commercial or advertisement upon which they relied and must describe with the requisite specificity the content of that particular commercial or advertisement."

Fogel gave Balthazar, Keller and Browning 30 days to file an amended complaint that must add the specifics he cited.

The judge gave the parties a period of 30 days in which to review their request, otherwise the case will be dismissed. Any device heats up after prolonged use and iDevices used in areas with high temperatures may display warning messages. These messages have the role of protecting the device against damage, but usually this kind of warnings appear very rarely. I, for example, have not had the "pleasure" of having that message displayed on my iPhone until now.
