Apple could remove iDevices from stores in Germany for not appearing at the trial

    Morning I told you that Apple could end up in the situation of being banned from selling iDevices in Germany after Motorola obtained a preliminary decision proving that Apple infringed two Motorola patents in the iDevices it sells. It seems that two courts in Germany have given two decisions by which they recognize the fact that Apple infringes two patents of Motorola in its iDevices, but the lawyers of the Cupertino company were not present at the procedural hearings in these cases.

    In practice, Apple's lawyers did not present defenses against Motorola's accusations and the decisions taken in the cases were simple production documents but in accordance with the law. Motorola can always ask for a ban on the sale of iDevices in Germany, but this has not happened and probably won't happen soon because Apple can appeal the decisions and when it does it will bring evidence that will convince the court that a banning the sale of iDevices would not be appropriate or in accordance with the law.

    The tactics of Apple's lawyers are interesting, but it remains to be seen what the final result will be.
