Samsung will include the iPhone 5 in the list of terminals for which it is judged, with Apple, but only after analyzing the device

  More than a week ago, rumors appeared that had as their source managers from within Samsung, who said that Apple will be sued as soon as the iPhone 5 is released on the market. The reason? Samsung say now officially that Apple infringes patents related to 4G LTE networks, but the Koreans said the same thing about the iPad 3, and so far they have not managed to win any lawsuit against Apple, although they have included the iPad 3 in several actions filed against those from Cupertino.

SEOUL—Samsung Electronics Co. said Thursday it will likely add Apple's iPhone 5 to a patent-infringement lawsuit between the two companies that is proceeding through a US court and due for trial in 2014. The South Korean company, in a document filed with US federal court in San Jose, Calif., late Wednesday US time, said it "anticipates" that it will accuse the iPhone 5 of infringing on the same patents as Apple's earlier iPhone 4S. The company added that it needs to examine the iPhone 5 first, however. It said the change in the lawsuit will likely come "as soon as it has had a reasonable opportunity to analyze the device."

  I don't think there were people who didn't expect Samsung to sue Apple because of the iPhone 5 because the whole process would bring a lot of free publicity to the Koreans. I am of the opinion that these processes will not have a positive finality for Samsung, at least from a legal point of view, but on the advertising side there is a lot to gain.
