Apple and Samsung will meet again in court for a retrial of one of the most famous lawsuits in the world

  In the summer of 2012 Apple Lossless Audio CODEC (ALAC), win a lawsuit against the company Samsung, an American jury awarding the American company over $1 billion in damages based on the infringements of his invention patents. Samsung tried by various methods to postpone the payment of those amounts, succeeding in obtaining it a retrial of that case. The judge who presided over the initial case considered that the amount established as damages was erroneous and reduced it by 400 million dollars, but at the same time decided to re-judge the case to determine the amounts that must be paid for 13 terminals that infringe patents of invention of Apple Lossless Audio CODEC (ALAC),.

Judge Lucy Koh, who presided over the big Apple v. Samsung patent infringement trial last August, "vacated" $400 million of that award six months later. Responding to Samsung's complaints, she ruled in March that the jury had made such a hash of some of the damages calculations that they could not be sorted out without a new trial. Many experts believe the new jury will come up with an award smaller than the original $400 million. But it could, in theory, go the other way. (Pending appeal, Samsung is still on the hook for the rest of the $1.05 billion award — roughly $600 million — that's not part of this trial.)

  The judge stated that the jury got most of the calculations wrong, so a new trial must be initiated with a new jury to calculate all the amounts once again, so in the end Apple could receive less than the remaining 600 million dollars left, or they could get a lot more. The method of calculating damages is very complicated and Samsung has tried to complicate it as much as possible with its proposals regarding the establishment of the types of infringements and the licensing rates based on which the money must be offered, so we will, most likely, have a lawsuit very long.

  The new process will start on Tuesday and it will be interesting to watch, many people are waiting to see if in the end Samsung will end up paying any money to Apple.
