The Bucharest Court fined RCS & RDS for the abusive clauses in the contracts

Through a decision pronounced on the merits, the Bucharest court fined the company RCS & RDS with the amount of 1000 LEI for some abusive clauses introduced in the contracts concluded by the clients who contracted its services, at the same time obliging the company to remove the respective clauses from all existing and future contracts.

The abusive clauses were found by ANPC through a verbal process with the number 0687073 which was concluded on 19.06.2015, and those from RCS & RDS attacked it in court, the latter winning the cause of the government agency and making a probably correct decision.

In the reasoning of the court decision, it is not specified the abusive clauses that are introduced in the contracts between RCS & RDS and clients, but probably those from ANPC will provide details about them through a press release in which they will brag about today's achievement.

Over the years, there have been many people who have complained about the abusive clauses that exist in the contracts of those from RCS & RDS, but now a court has confirmed their existence and sanctioned the company, the amount imposed being small, unfortunately.

Accept the request. It maintains the dispositions recorded in the proc-verb. of finding contrav. no. 0687073/19.06.2015 as being thorough and legal and, consequently, finds the abusive nature of the object clauses of the proc-verb. mentioned and, implicitly, the contraventional nature of the act of inserting abusive clauses inserted into the contracts concluded with the clients, respectively the contravention in question. RCS-RDS, prev. of art. 13 (1) in conjunction with art. 1 paragraph (3) from Lg. 193/2000. It has the obligation to pay. RCS-RDS to the modification of the clauses found to be abusive and to the elimination of these clauses from the Additional Act according to proc-verb no. 0687073/19.06.2015 for all contracts in execution, according to art. 13. According to art. 16 L 193/2000 orders the sanctioning of par. with a fine of 1.000 lei. With appeal according to art. 14 L 193/2000. Pronounced in public session, today 21.03.2016.
