RCS & RDS: FINE for Not Connecting a Customer

RCS & RDS was fined by ANPC for not contacting a customer, this is how much the telecom operator has to pay for its negligence.

RCS & RDS is the fixed internet service of the telecom operator RCS & RDS in Romania, having a very large number of clients throughout the country, and offering internet browsing speeds of up to 1 Gbps. Digi Net it is the service that is the basis of a fine that those from RCS & RDS received, being forced by ANPC to pay the sum of 5000 LEI for not connecting a customer to their fixed internet network in a timely manner.

RCS & RDS would have exceeded the 180-day deadline for connecting the client, in accordance with the provisions written in the contract concluded for the provision of fixed internet services in Brasov county. Those from RCS & RDS would have said that they would not have known that within the radius of the customer's home there would be no poles on which to mount the fiber optic network, but the Brasov court rejected, in the first instance, the appeal made by the operator against the imposed fine by ANPC.

RCS & RDS also refused to respond to the customer after sending two notices regarding the deadline for the installation of the fixed interest service, as often happens, so she was rightfully fined. The judges upheld the decision of the ANPC and the fine imposed on the RCS & RDS, and if the company will not be more convincing in the appeal, then the fine will remain valid, its value being anyway the lowest in relation to the company's receipts.

"It was noted that RCS&RDS concluded on 17.02.2017 (...) contract no. xxxxxxxxxx, the company committing to the consumer to install and provide him with the services mentioned in the contract. Since after 3 months from the conclusion of this contract, RCS&RDS did not fulfill its obligation to install the contracted services, the consumer made notifications and requests to the company (addresses no. xxxxxxxxxx/18.05.2017 and no. xxxxxxxxxx/13.06.2017) in order to communication of a resolution in order to resolve his requests and fulfill the obligations assumed by the company under the contract, RCS&RDS refusing to communicate to the consumer his response to these requests and without installing the services mentioned in the contract, the consumer addressing ANPC with a complaint in this regard."

RCS & RDS is known for problems of this kind that customers have with fixed internet or television services, the same being also true for television or fixed telephony services. RCS & RDS is a very large company, and in many situations there are delays either in connecting customers or in solving technical problems, but few of the customers actually end up filing complaints with the ANPC, but without them things do not change for the better.
