RCS & RDS today he was left with a final fine, initially given by ANPC, for the way he treated a client with whom he concluded a contract over the phone, but whom he did not correctly inform about his rights. on March 3, 2017, RCS & RDS concluded a contract at a distance, by telephone, with a client, who was informed that he had the right to renounce it 10 days after the conclusion, not 14 days, as provided by the legislation of Romania.

RCS & RDS was fined on April 11, 2017 by ANPC for non-compliance with Romanian legislation, but the company contested the decision of the authorities in court, and today the final decision came. RCS & RDS was fined 5000 LEI for not correctly informing the client about the term in which he can request the unilateral termination of the contract concluded at a distance, without paying any amount of money to the operator .

RCS & RDS was also fined a few months ago for not respecting its customers, so we are not talking about any measure taken for the first time against the telecom operator in Romania, unfortunately. However, this time an issue is settled that may have affected other Romanians, who did not have the patience to complain to the authorities about RCS & RDS, and to wait 1 and a half years for a court to decide to cancel the concluded contract by the operator with the erroneous information of the client.

"Through the minutes of the finding of the contravention drawn up on 11.04.2017, the ascertaining agent from the respondent ANPC Sibiu charged RCS&RDS with committing the contraventions provided for by articles 18, 51 and 9 of OG 21/1992, and applied the sanctions the fine in the amount of 5.000 lei for the first act, respectively a warning for the other two acts, because it was found on 20.03.2017, following the investigation of complaint no. 463/2.03.2017 of a customer regarding the telephone offer for a mobile phone subscription for which he was informed by an employee of RCS&RDS that he would have 10 days to renounce this remote contract, that on 02.03.2017 .9, this consumer was wrongly informed about the right to withdraw from the contract concluded at a distance, as provided for in article 34 of GEO 2014/10, the consumer being informed that he can withdraw from the contract within a maximum of 14 days, and not XNUMX.”

RCS & RDS is one of the largest telecom groups in Romania, with over 6 million customers throughout the country, most of whom are subscribers to mobile phone services at the moment. The fine applied against those from RCS & RDS is the lowest in relation to the company's income, but if more clients would have the courage to report problems of this kind, then they would probably disappear completely in the future.
