Minister of Health New Important Order Signed Announced All Romania

The Minister of Health signed a new order that imposes a series of important changes in Romania, and I talked about them in a first phase the other day, when I told you that the legal regime of plants, substances and narcotic preparations is changing and psychotropics used in veterinary medicine.

The Minister of Health also issued a procedure together with the new order, and below you can see its provisions regarding the way in which the control and supervision of the preparation operations of these medicines is exercised, all according to order 1.328/56/2022.

"The activity of control and supervision of the operations provided for in art. 1 is carried out by the National Veterinary Sanitary and Food Safety Authority, through its own control structures, as well as by the county sanitary-veterinary and food safety departments, respectively of the municipality of Bucharest, according to the provisions of art. 7 para. (1^3) from Law no. 339/2005, with subsequent amendments and additions.

The control and supervision of the operations provided for in art. 1 is carried out through checks carried out according to the annual control plans and specific procedures developed by the control structures provided for in paragraph. (1), with duties in the field of veterinary pharmaceuticals. Each control action carried out at authorized sanitary-veterinary units for carrying out operations with narcotic and psychotropic preparations is concluded by drawing up a control note, which is communicated to the economic operator.

The official veterinarian with powers of control of authorized sanitary-veterinary units for carrying out operations with narcotic and psychotropic preparations has the right of access, without prior notification, to the premises where these operations are carried out, as well as to their specific documents. The official veterinarian with control duties takes samples, as appropriate, for laboratory testing.

If, through the controls carried out by the specialized staff of the National Veterinary Sanitary and Food Safety Authority, respectively of the units subordinated to it, it is found that the sanitary-veterinary conditions stipulated by the legislation in force are not met, the following can be ordered measures: contraventional sanctions, in accordance with the legal provisions in force.

Suspension of the activity for which the sanitary-veterinary conditions are not met, in accordance with the legal provisions in force. Prohibition of carrying out the activity for which the sanitary-veterinary conditions are not met, in accordance with the legal provisions in force. Whenever, in the framework of a control activity carried out according to the provisions of this procedure, a violation of the provisions of Law no. 143/2000, the specialized staff within the ANSVSA, respectively of the units subordinated to it, notify the competent criminal investigation bodies."
