Procesul de 2.8 miliarde de dolari intentat Apple

Compania Apple este tinta unui noi proces intentat astazi impotriva sa la o instanta din SUA, o companie numita VoIP-Pal cerand 2.8 miliarde de dolari pentru incalcarea unor brevete de inventie proprii prin lansarea iDevice-urilor celor de la Apple.

Suma de 2,836,710,031 reprezinta 1.25% din incasarile inregistrate de catre Apple prin vanzarea de iPhone, iPad si iPod Touch-uri, iar tehnologia problematic aeste cea VoIP care este folosita pentru FaceTime si o multitudine de alte aplicatii pentru iOS.

Compania VoIP-Pal descrie in cererea sa de chemare in judecata modul in care Apple ii incalca brevetele de inventie si intregul sistem este destul de complex, dar ideea de baza este ca Apple se foloseste de tehnica altcuiva pentru a obtine ceea ce isi doreste.

Desi cererea de chemare in judecata a fost depusa pe 9 februarie, pana ieri s-a cerut suspendarea initierii procesului deoarece VoIP-Pal a incercat sa negocieze cu Apple o plata a despagubirilor, insa se pare ca aceste discutii nu au avut vreo finalitate pozitiva deocamdata.

Instead of pursuing independent product development, Apple employed VPLM’s innovative caller attribute classification and routing product design, in violation of VPLM’s valuable intellectual property rights.

Desi instanta va incepe sa analizeze cererea de chemare in judecata, cele doua companii vor putea oricum sa discute in continuare o eventuala rezolvare amiabila a problemelor, asa ca in final totul s-ar putea rezolva in afara instantei si cu o pierdere mai mica pentru Apple.

In particular, devices running the iMessage application initiate a communication between a caller and a callee. The callee may be an Apple subscriber or a non-subscriber. In the case that the callee is an Apple subscriber, the communication is sent using iMessage. On the other hand, if the user is not an Apple subscriber or if iMessage is not available, the communication is sent using SMS/MMS. Apple’s messaging system directly and/or indirectly practices certain claims of the ‘815 patent in order to determine the classification of a user, and, subsequently, how the call should be routed.
