Samsung appeals against the decision to grant a temporary ban on sales of the Samsung Galaxy Nexus

  Last week we told you that based on a patent for Siri, Apple has the possibility to impose a temporary ban on the sales of the Samsung Galaxy Nexus terminal in the USA, but only if he posts a bond of 96 million dollars in a court in the same country. Those from Samsung didn't wait too long either they introduced an appeal against the decision citing various grounds that the right to impose the sales ban order should be suspended for the duration of the appeal, or until such time as a federal court makes a decision in this case.

As expected, Samsung's lawyers worked hard to define their appellate strategy concerning the Galaxy Nexus injunction that was ordered on Friday afternoon Pacific Time. They just gave notice of their appeal to the Court of Appeals for the Federal Circuit and, like in the Galaxy Tab 10.1 case, filed a motion to stay the injunction for the entire duration of the appeal or at least until the Federal Circuit decides on a possible stay. NOTICE IS HEREBY GIVEN that Defendants Samsung Electronics Co. Ltd., Samsung Electronics America, Inc., and Samsung Telecommunications America, LLC appeal to the United States Court of Appeals for the Federal Circuit from the June 29, 2012 Order Granting Motion for Preliminary Injunction entered in the above-captioned action, and each and every part thereof.

  Although Samsung has, from its point of view, every reason to ask for the suspension of the imposition of the sales blocking order, it seems that there is little chance that this request will be fully approved. There is a possibility that the magistrate in charge of judging the case will suspend the order until a federal court makes a decision, but this would stop the options of those from Samsung. Given that Apple has already imposed a temporary block on sales of the Samsung Galaxy Tab 10.1 in the US, there are quite high chances that the same thing will happen to the Galaxy Nexus.
