Minister of Health Official Decisions Last Time Important Romanians

The Minister of Health took a new extremely important decision for Romanians from the whole country, and this is because we are talking about measures imposed for the whole of Romania starting from now, they aim at the use of medicines to solve special health needs in Romania.

The Minister of Health issued order 1.320 in this regard, and below you can see all the provisions that this order imposes throughout Romania, they are important enough to be taken into account by everyone, especially as they regulate special situations that take place in our country.

"Seeing the approval report no. AR 7.500/2022 of the Medicines, Devices and Medical Technologies Policy Directorate of the Ministry of Health, considering the provisions of art. 703 para. (2) from Law no. 95/2006 regarding health reform, republished, with subsequent amendments and additions, pursuant to art. 7 para. (4) from Government Decision no. 144/2010 on the organization and operation of the Ministry of Health, with subsequent amendments and additions, the Minister of Health issues the following order.

The rules for applying the provisions of art. 703 para. (1) and (2) of Law no. 95/2006 regarding the reform in the field of health related to the medicines used to solve special needs, approved by the Order of the Minister of Health no. 85/2013, published in the Official Gazette of Romania, Part I, no. 93 of February 14, 2013, with subsequent amendments and additions, is amended and supplemented as follows:

In article 12^1, paragraph (7^1) is amended and will have the following content: (7^1) If the lowest price is proposed by two or more distributors, the estimated requirement according to paragraph (1) is divided between them in proportion to the proposed quantities.

In article 12^1, after paragraph (7^1), a new paragraph, paragraph (7^2), is inserted, with the following content: (7^2) If, following the analysis of the information communicated by the authorized wholesale distributors, The Ministry of Health notes that no proposal covers the entire amount provided for in paragraph. (3) lit. d), all submitted proposals may be admitted, with the appropriate application of the provisions of para. (7^1), if the following conditions are met.

The distributors have expressed their intention to put the medicine on the market within the term provided for in paragraph. (3) lit. b), distributors accept the lowest price among the offers submitted for the medicine with the same commercial name (same pharmaceutical form and concentration), within 3 working days from the communication of the lowest price by the Ministry of Health."
