Minister of Health Important Government Ordinance Regulates Health

The Minister of Health has published a very important Ordinance of the Government of Romania which is to be adopted by the executive in the following weeks, its purpose being to modify the law 95 of 2006 regarding the reform in the field of health, more precisely for the regulation of the organization of certain centers for prevention, diagnosis and treatment.

The Minister of Health speaks below about the necessary measures for the creation of these centers in situations of biological and epidemiological risk, as defined by law 136 of 2020, all of which are part of a much larger process of changes that are to be adopted in satisfied Romania this document which is now in the process of public debate.

"In order to regulate the situations in which the Ministry of Health can order the organization of specific centers for carrying out activities of prevention, diagnosis and treatment in situations of biological and epidemiological risk defined in art. 6 of Law 136/2020, the amendment of art. 25.

In order to eliminate the difficulties of interpretation and qualification regarding the legal nature of the contracts through which the national curative health programs are carried out in the legal system, but also to ensure concordance with the legislation that regulates the provision of medical services, medicines and medical devices , which are part of the basic package, the intervention of the legislator is necessary for the express regulation of their legal nature.

For the regulatory unit, the draft normative act proposes to attribute the civil nature of these legal relationships, considering the similarities between the two contracts in terms of their object, as well as the parties involved. Likewise, it ensures the clarity and predictability of the regulation by establishing the way of organization, operation and control of the activity carried out by providers within the national curative health programs.

Included as a source of funding for the FNUASS budget are the sums from the protocols concluded by CNAS with the marketing authorization holders or their legal representatives, the sums from the mandatory commitments assumed by the marketing authorization holders, according to the decisions of the European Commission issued in application of Regulation (EC) no. 1/2003 of the Council of 16 December 2002 on the implementation of the competition rules provided for in Articles 81 and 82 of the Treaty.

According to Law no. 1/2021, one of the result indicators, which will be the basis of the draws worth 75.000.000 Euros, is DLI#1: Alignment of the minimum package of services in primary health care provided to uninsured people with the package of basic services in assistance primary healthcare granted to insured persons."
