The Minister of Health has prepared for adoption a very important Government Decision, which brings to the attention of Romanians a series of decisions taken for our country, and this because an important donation from South Korea will bring to Romania many important medical and IT equipment.
The Minister of Health explains below what is behind this donation, how it would be carried out, and how all the products would be received by the Romanian state, without explaining how they would be distributed, so that be interesting to see what will happen to them after receiving them.
"At the moment there is a Memorandum of Understanding regarding cooperation in the field of health between the Ministry of Health and the Ministry of Public Finances from Romania and the Ministry of Health and Protection from the Republic of Korea, signed in Seoul on October 20, 2016. The document was signed on the occasion of the participation of the delegation of experts of the Ministry of Health and the Ministry of Public Finance at the Korea Business Matching Trip "Hospital Facilities Management PPPs" meeting.
The draft normative act is a document preceding the signing of the handover-acceptance report of medical equipment, medical equipment, IT equipment and motor vehicles, hereinafter referred to as goods, by the Ministry of Health. Pursuant to art. 108 of the Constitution of Romania, republished, of art. 291, 299 and art. 362 para. (1) and (3) of the Government Emergency Ordinance no. 57/2019 on the Administrative Code, with subsequent amendments and additions, as well as the provisions of art. 867 of Law no. 287/2009 on the Civil Code, republished, with subsequent amendments,
Art.1 – (1) It is accepted, from the Republic of Korea, for the Romanian state, the donation consisting of medical equipment, medical equipment, IT equipment, and vehicles, provided in Annexes 1 and 2, which are an integral part of this decision, in total value of 48.072.941,71 lei, including VAT.
(2) The Ministry of Health will take the legal steps in order to make the payment related to VAT in the amount of 7.675.511,70 lei.
Art.2 – (1) The Ministry of Health fulfills the formalities of accepting the donation on behalf of the Romanian state. (2) Delivery-reception of goods provided for in art. 1 para. (1), is achieved by concluding a handover-acceptance protocol between the representatives of the Republic of Korea and the Ministry of Health, within 90 days from the date of this decision.
Art. 3 – The goods provided for in art. 1 para. (1), become the private property of the state on the date of signing the minutes of delivery-acceptance provided for in art. 2 paragraph (2) and are placed under the administration of the Ministry of Health starting from the same date in order to distribute them, by order of the Minister of Health in within 60 days from the date of their receipt."
