A Hong Kong judge found that Proview conspired to exploit Apple

  In China, the company Proview cooperated with state authorities to seize dozens of iPads from some stores, Apple has asked partners who sell iPad tablets without authorization to remove them from sale and all because those from Apple are not recognized for the purchase of the iPad brand in China. Apple bought this brand from a company called Proview which is based in Hong Kong. The purchase theoretically allows Apple to use the iPad brand in several countries around the world, but Proview claims that Apple does not have the right to use it in China. Although a Hong Kong judge recognized Apple's rights in China, a judge from the neighboring country disagreed and allowed Proview to remove iPad tablets from certain stores.

The conduct of all the defendants demonstrated that they have combined together with the common intention of injuring Apple and IP Application [Apple's agent in the purchase] by acting in breach of the agreement. Proview Holdings, Proview Electronics and Proview Shenzhen, all clearly under [Proview CEO Yang Rongshan's] control, have refused to take any steps to ensure compliance with the agreement so that the China Trademarks are properly assigned or transferred to [Apple]. Instead, they attempt to exploit the situation as a business opportunity for the Proview Group by seeking an amount of US $10 million from Apple.

  Those from AllThingsDigital obtained a copy of the decision of the Chinese judge who ruled in favor of Apple, and in that decision the judge claims that Proview is conspiring to exploit Apple. The judge mentions that Proview willfully violated the agreement concluded with Apple out of "financial desperation". Unfortunately, those mentioned by the player from Hong Kong are not very relevant in China and based on them Apple cannot get anything. Even so, the decision proves that Apple is at least partly right, but it remains to be seen how it will convince the Chinese courts to recognize the same thing.
