Quickmobile, warranty for iDevices and the right to reply

Two days ago I published this article and those from quickmobile asked me to give them the right to explain their policy regarding guarantees. Below is the entire response they sent to me.

In the article published on your blog (http://goo.gl/XRZV2) you incorrectly presented the warranty situation offered by our company for Apple products.

We would like to specify that, as can be seen from the initial answer, we make absolutely no reference to the approval or non-approval of a particular software offered by a particular company. Our warranty conditions refer exclusively to the approval of an update method, namely the OTA (over-the-air) update, because such an update method presents certain safety elements that eliminate some of the problems that may arise during a such procedures. During an OTA update procedure, an intermediate device that could negatively affect the mobile terminal (due to physical defects or software security problems present in the intermediate device) is removed. An update using an intermediate device can only be performed by an authorized person (by authorized person we mean an authorized person appointed by the manufacturer or by our company). These terms of service are established by our company taking into account Apple's general warranty policy, which can be seen on the official page (namely: http://www.apple.com/legal/warranty/products/ipad-english.html and http://www.apple.com/legal/warranty/products/iphone-english.html). The pertinent point in these two links is "WHAT IS NOT COVERED BY THIS WARRANTY?", namely the second paragraph, letter "(f)" which specifies that any upgrade or expansion intervention (without making a distinction between upgrade/expansion hardware or software) will void the warranty if performed by a person who is not an Apple representative or an Apple authorized service provider. Having this information, we believe that we have every right to establish our own rules in accordance with and within the limits of the country's legislation.

For greater transparency, we would also like to present to you a situation of the commercialization (retail and distribution) in Romania of Apple products (iPad and iPhone) and of service entries for this type of product in the period 20.12.2011 - 20.05.2012:

– iPhone: Out of the total number of products sold (iPhone 3, 3GS, 4 and 4S), 33 units returned to service during this period. Of these entries, the warranty was canceled on 2 products for improper use (activation of humidity sensors/oxidation of internal components and in the second case it was a cracked screen).

– iPad: Out of the total number of products sold (iPad1, iPad 2 and the new iPad), 19 units returned to service during this period. From these service entries, the warranty was canceled for 2 products due to improper use (for the first product it was a deformed case of the product, with traces of mechanical shocks and in the second case it was a cracked display - defective repaired under warranty).

As can be seen from the information above, during the presented period there was not even once a question about canceling a warranty for software updates.

In conclusion, we would like to state that we are probably the only company in Romania that offers a 24-month warranty for all Apple devices sold (iPhone, iPad, MacBook and iPod). Also, all the products sold by our company benefit from a door-to-door system guarantee, our customers no longer having to waste precious time with the delivery of a product to the service unit.
