The Government of Romania, through the Ministry of Internal Affairs, offers today a series of answers to the questions that Romanian citizens have regarding the travel restrictions for Easter, and not only, because of the military ordinances that were adopted and imposed in Romania.

The Romanian government provides concrete cases regarding the Easter trips that various people have made in Romania up to the present moment, and provides answers for the situations encountered by some of the policemen who sit at the filters all over the country.

The Romanian government does not yet want to relax before Easter the restrictions on travel that take place throughout the country, but based on what we see below, not everything is so strict.

"Considering that at the level of the Strategic Communication Group, other questions were received regarding specific situations regarding the observance of social distancing measures, but also to meet the situations related to the Easter holidays in the context of this year, we provide you with a update to the originally presented material.

1. Question: Can I go and buy my lamb from the authorized economic agent where I used to buy it every year? What do I put on the statement?

răspuns: Yes, but you must have your identity card and the affidavit with you, in which you check point 2 (assurance of goods that cover people's basic needs). We also recommend that you go alone, not with several family members, and to make sure that the economic agent is authorized and complies with all the sanitary conditions imposed by the institutions with powers in the field. Don't forget to ask for the documents of origin, tax receipt, receipt or invoice.

2. Question: Can the person I buy lamb from every year come and bring it to my house?

răspuns: Yes, he can come, but he must have on him the necessary documents according to the military ordinances and the documents of origin of the products and be able to issue a tax receipt, receipt or invoice.

3. Question: Do merchants still come with flocks of lambs at the entrance to the city?

răspuns: Not. This is not possible.

4. Question: Can I go to my parents to bring them products for the Easter meal?

răspuns: Of course. According to the military ordinance, you must carry your identity card and the affidavit, in which you check point 4, justified reasons, such as assistance to elderly, sick people. We also recommend avoiding direct or close contact with elderly people. We remind you that people infected with the new type of coronavirus can be asymptomatic, that is, they do not show symptoms, but they can transmit the virus very easily, and the elderly represent a vulnerable category, with a high risk of death.

5. Question: Can I visit my parents and eat with them on Easter?

răspuns: According to Military Ordinances, courtesy visits are not allowed on Easter Day, but only travel to supply relatives who cannot supply themselves with the necessary products. At the same time, it is recommended, as much as possible, to avoid direct or close contact with elderly people. We remind you that people infected with the new type of coronavirus can be asymptomatic, that is, they do not show symptoms, but they can transmit the virus very easily, and the elderly represent a vulnerable category, with a high risk of death.

6. Question: Can I participate in the Resurrection service at the church?

răspuns: This year the Holy Week services (of the Holy Passions) and Easter will be performed only by church ministers, without the participation of the faithful, being transmitted online and on TV channels.

7. Question: Can I go to the cemetery during this period, to perform Christian rituals?

răspuns: These situations are regulated by military ordinances that only allow funeral/wedding/baptism services held with a small number of people (maximum 8). Traveling to the cemetery for other reasons is not regulated nor can it be considered an emergency.

8. Question: Can I take children outside for a walk?

răspuns: Yes, under the conditions of art. 1 letter d) from Military Ordinance no. 3 where it is stipulated that short journeys can be made, near the home, related to individual physical activity. However, you will not go to parks or playgrounds, where there are higher risks of catching the virus, and it is not allowed to move in public, pedestrian spaces in groups larger than three people. The exit of the minor child will always be accompanied by the adult who takes care of him.

9. Question: Can I go fishing?

răspuns: In the case of sport fishing, even if this type of activity is generally practiced independently and not in a group, it is not provided as a justified travel or related to individual physical activity.
There may be situations when the fishing place is in the vicinity of the home (example: the home is on the shore of a lake) in which case the requirement provided for in Article 1 letter e) of Military Ordinance number 3 can be met, respectively short trips are allowed , near the home, for individual physical activity.
By military ordinance number 8, commercial fishing is regulated and allowed, not sport or recreational fishing.
These activities must be carried out in strict compliance with all normative acts in the field, including those that establish prohibition periods for certain species.

10. Question: How can people who cannot read and write get around?

răspuns: Completing a self-responsibility declaration is a mandatory condition for travel outside the home, except for situations when the travel is to/at work. People who cannot complete this declaration will have to call on the support of relatives/neighbors or local authorities, through social assistance services.

11. Question: I spent 14 days in self-isolation at home, it being my decision to protect myself. Can I leave the house now?

răspuns: If it is not an isolation measure imposed by the authorities, you can leave your home at any time when you are in any of the situations provided for in Military Ordinance no. 3 and 4. If the measure was imposed by the authorities, you will have to notify DSP that you have completed the isolation period to know what is the conduct to follow.

12. Question: Can I drive to the car service?

răspuns: The activity of car services, parts stores and car dealerships or other relevant institutions is not prohibited by any Military Ordinance, with the exception of those operating in large shopping centers.

If the car has a defect that does not allow it to be used safely, the person traveling to the service/car parts store/representation or other specialized units can do so by completing the self-responsibility declaration, the point regarding the coverage of needs the person/ justified reason.

In the case of purchasing a part or a car, the person must also have a document proving the transaction (invoice, power of attorney, contract, etc.)

13. Question: Can I go to the car wash to wash my car?

răspuns: Yes, trips to car washes to clean cars are allowed, when this is necessary, but in strict compliance with the provisions of military ordinances. Travel can be done by completing the declaration on your own responsibility at the point regarding covering the person's needs/justified reason.

14. Question: Are we allowed to go out after 22.00 in the vicinity of the house, if we have a church nearby?

răspuns: You can go out in the vicinity of the house, outside the courtyard, to receive the light from the volunteers with whom the Romanian Patriarchate collaborates this year, you can stay in the vicinity of the house to listen to the service, but you cannot go to the church, no matter how close it is located by the house and the formation of groups larger than three people is not allowed.

If you live in a block of flats, you can also leave the house to receive the light brought by the BOR volunteers, but it is essential to respect the rules of social distancing, not to crowd the stairwell of the building and not to form groups larger than three people. 15. Question: Can we listen to the service from the street?

răspuns: Strictly listening to the service cannot be cited as a reason for moving outside the home, and the remaining in the street of several people who might want to do so could lead to the formation of groups larger than three people, implicitly in violation of the provisions of the Military Ordinances number 2 and 4.

16. Question: Is it allowed to organize (family) parties in the yard of one's own house, on the night of the Resurrection or on Easter Sunday?

răspuns: If by party is meant only the participation of family members, those who normally live there, without inviting other people/relatives, yes, it is allowed. However, the legal provisions regarding keeping the hours of rest must be respected and without disturbing the public peace.

17. Question: Is it possible to witness/listen to the Resurrection service, in front of the church, from one's own car, without making contact with the outside?

răspuns: Listening to the job is not a reason why affidavit travel can be allowed.

18. We intend to go to the old house where we have our own orchard of fruit trees to do spring pruning and spraying. The house is 500 km from Bucharest. My husband and I also have to leave and automatically and children (both minors). What do we have to tick on the Declaration to avoid problems? Are there any travel restrictions?

răspuns: According to Military Ordinances no. 3 and no. 4, the movement of people is allowed, without specifying a specific distance, for agricultural activities. This exception was introduced mainly to assist agricultural producers and people who derive their sole or main income from agricultural activities and not to be used as a pretext to carry out movements by any person who owns land . We remind you that non-compliance with the provisions of the Military Ordinances is sanctioned as a misdemeanor.

19. My friend and I live in Bucharest and we intend to move to Câmpulung, where my parents are, to bring them food and to stay with them during this period, because they are 65 years old - father, and mother 63. If we still have the possibility to help them (we work from home), we thought it would be good to do it, so that they don't leave the house, thus exposing themselves to the risk of illness. Besides, it would also be better for us to retire there, as we would have better conditions (courtyard, fresh air).

răspuns: In accordance with Military Ordinances no. 3 and no. 4, it is allowed to move people for justified reasons, such as assisting the elderly, sick or disabled, who cannot provide for themselves or single households.

But, although we are convinced that it would be more comfortable for you to live with your parents, in the yard, we remind you that people infected with the new type of coronavirus can be asymptomatic, that is, they can not show symptoms, but they can transmit the virus very easily, and elderly people represent a vulnerable category, with an increased risk of death.

20. Due to military orders, all hospitals are currently only treating people infected with the Coronavirus. My question is when exactly will the medical staff be able to deal with the other patients who urgently need operations, oncological treatments?

răspuns: The Department of Emergency Situations released on Wednesday, April 8, a series of clarifications regarding the application of the order on the suspension of surgical interventions, as well as other surgical treatments and investigations, making it very clear that the bans are not absolutely applicable and automatically, but based on the analysis of the treating specialist, which can justify:
- the need to admit patients, for the hospital assistance provided in public and private hospitals or
- the need to carry out outpatient consultations or treatments, in public or private units that provide outpatient medical assistance.
For example, the prohibitions do not apply to pregnant patients or people who require oncological treatment and who need mandatory periodic ambulatory checks for monitoring and investigations, and who continue to receive medical assistance, regardless of the public or private system chosen.
In conclusion, only those medical activities, consultations or treatments that are not mandatory and can be rescheduled are suspended. The decision to postpone is made based on the analysis of the treating specialist. For each patient hospitalized or consulted in an outpatient setting, there must be a medical documentation that objectively justifies the need to perform the medical act, both within hospital units with hospitalization. as well as in the case of ambulatory structures.

21. Is it legal to transport my wife to work in Tăndărei and under what conditions considering that the city is under quarantine. I mention that the wife works in Tăndărei, and we live in another locality.

răspuns: Regarding your wife, Military Ordinance no. 7 (whose text can be consulted here https://www.mai.gov.ro/wp-content/uploads/2019/01/OM-7.pdf-1.pdf) provides for the categories of persons whose access is permitted in the quarantined locality. Your access will not be allowed in the town.
As for moving to the limit of the locality, if you consider that the reason for moving is justified, you can do so by completing the declaration on your own responsibility in relation to the provision of art. 1 letter. d) from Military Ordinance no. 3 (moving for justified reasons, such as child care/accompanying, assistance to elderly, sick or disabled persons or death of a family member - these being by way of example).
As can be seen, the situations included in the norm are exemplary in nature, but they assume grounds of a certain importance and urgency.
A situation like the one indicated by you could be justified if there is no means of public transport or if the risk of exposing the wife to infection is greater (commuting to work would involve changing several means of public transport, waiting times in stations, etc.). Please also take into account the provisions regarding people over 65 years old.

22. What can I fill in on the self-responsibility declaration to travel to my girlfriend's residence? I mention that the journey will be made by personal vehicle.

răspuns: In the content of art. 1 of Military Ordinance no. 3/2020 specifically mentions the exceptions to the ban on the movement of people outside the home/household. We send you the link from which you can download and consult the affidavit, where you can check the reason for the move, which must be justified.

23. Where can the COVID-19 fines be paid? At which units can contravention fines be paid for non-compliance with the measures ordered during the state of emergency? We specify that we were contacted by several citizens, who claimed that they asked by phone at town halls, the police, the post office, TelVerde covid and even the MAI, and each time they were told that they did not know where they could pay the fine. We also specify that not all citizens can pay the fine online or do not know exactly what the procedure is and that through GEO 34/2020 it was provided that the deadline for payment and enforcement of these fines is not suspended during the state of emergency.

răspuns: The Ministry of Public Finance made clarifications regarding the application of the provisions of GEO 34/2020 for the amendment and completion of GEO 1/1999 regarding the regime of the state of siege and the regime of the state of emergency.
Thus, the authorities and public institutions whose jurisdiction is responsible for the detection and sanctioning of contraventions resulting from the military ordinances approved under Government Emergency Ordinance no. 1/1999 were informed that when drawing up the minutes of the detection of the contravention and, possibly, the guidance of the sanctioned persons, to take into account the indication of the income account 20A350102 "Income from fines and other sanctions applied by other specialized institutions", so that the payments are made correctly by the violators.
The competent bodies subordinated to ANAF will be informed by the Ministry of Public Finance for a uniform application of the legislation.

Fines can be paid as follows:
- accessing the www.ghiseul.ro page
- selecting the "Pay Military Ordinance Fines" section
- completing the online form with the requested data
- making the payment by filling in the card data in the secure page of the payment processor.

24. Where can I find the correct affidavit template? Do I have to present it physically or is it enough to show the picture on my phone?

răspuns: Military Ordinance 3/2020 provides in art. 4 para. (3) that "The affidavit must include the name and surname, date of birth, home address, reason and place of travel, date and signature". This assumes that the document can be drafted/completed from the PC/laptop in the predefined fields, in PDF format, requiring printing and the holder's holographic signature. You can then take a photo of it and save it to your phone/tablet to present to the authorities.
Until now, the only legal way to authenticate the self-responsibility declaration is the holographic signature. This holographic signature makes that, for that signed act, there is legal liability, with all that this implies in the situation where the person would be held liable. As for the electronic signature, it has to go through some preliminary validation steps for the person using it and requires a certain regime of use.

25. I live in the town of Vișeu de Sus, Maramureș, and I would like to go to Cluj, where I live during university courses, to recover some personal things.

răspuns: In the content of art. 1 of Military Ordinance no. 3/2020, the exceptions to the ban on the movement of people outside the home/household are specifically mentioned.
In order to prevent the spread and minimize the effects on the health and life of all Romanians, it is very important that every citizen is aware of the responsibility they have in this regard, and not only through the coercive intervention of the status authorities.
We remind you that non-compliance with the provisions of the Military Ordinances is sanctioned as a misdemeanor.

26. I am the mother of an autistic teenager who is unable to understand the current restrictions and whose anxiety has greatly increased since we have been staying at home, increasing his aggression towards himself and those around him. We can't even go out in front of the block, because he doesn't understand that we can't move away and he can become violent. We are allowed to drive him around in his personal car (his father would drive and I would supervise him, without getting out of the car and without having contact with other people), for therapeutic purposes, being one of the few things that reduce his anxiety and aggressive behaviors in addition to medication?

răspuns: Considering the situation presented, as well as the provisions of Military Ordinance no. 4/2020, in the self-responsible declaration model, for the reason for travel, you can check point 4 "justified reasons, such as caring for/accompanying a minor/child, assisting the elderly, sick or disabled or death of a family member" .
As you also wrote, in order to avoid contact with other people, as a preventive measure against the spread of the new coronavirus, we recommend that you use your own car, if it helps the child therapeutically.
In this case, both you and your spouse must present to the competent authorities, at the time of the checks, the identity documents and self-responsibility declarations, in which, under "Reason for travel", you can check point 4, as mentioned above , and under "Place(s) of travel" state a pre-arranged route as far as possible. Also, for your child, you must present the identity document, as well as medical documents attesting to the conditions they suffer from.

27. I live in Argeș county, but during the faculty I stay with my sister in Bucharest. Can I move into her apartment during the restrictions so that I have all the necessary materials there to continue the college classes that are now online?

răspuns: We recommend that you have with you the declaration on your own responsibility in which you have ticked point 10 for the reason for travel: "the provision of goods necessary to carry out the professional activity", as well as a document attesting to the fact that during this period the faculty continues the courses (e.g. a certificate/ a schedule of courses/exams or an official announcement). Thus, when you are checked by the competent authorities, you can justify your presence in the city of Bucharest, under the conditions in which a state of emergency is declared at the level of Romania.

28. Can people over 65, as natural persons, who have land outside the city that they work for their own consumption (tomatoes, onions, potatoes, etc.) travel there? The only document he can present is the title deed of the house/land.

răspuns: According to Military Ordinance no. 3. of 24.03.2020, art. 3. - The circulation of the persons provided for in art. 2, outside the home/household, it is also allowed outside the time interval 11.00 - 13.00, if it is done in professional interest or for carrying out agricultural activities. This exception was introduced mainly to assist agricultural producers and persons who derive their sole or main income from agricultural activities and not to be used as a pretext for movement by any person who owns land . In order to carry out a journey for agricultural activities, it is necessary to fill in a self-responsibility declaration.

29. For people who return to the country from the yellow zone, but in the last 14 days they were also in the territory of a country in the red zone, is quarantine or isolation required? Does the institutionalized quarantine take place in the town of origin of the person concerned or in the town where he arrives upon his return to the country?

răspuns: False statements constitute a crime, as provided for in art. 326 of Law no. 286/2009 regarding the Criminal Code, with subsequent amendments and additions.
In relation to the persons entering the territory of Romania, the authorities will take the legal decision according to what was declared, and will subsequently verify the veracity of the information provided.
We make it clear that from March 24, 2020, for all persons entering Romania, the measure of isolation at home or, as the case may be, quarantine, as provided for in art. 5 para. (1) from Military Ordinance no. 3.
By consulting the website of the National Institute of Public Health you can check which countries are included in the RED ZONE - for which the measure of institutionalized quarantine for 14 days is imposed. It is not relevant if the person spent a longer period in that country or was just passing through.
Regarding the location where the quarantine is ordered, it is established in special spaces provided by the local authorities, within the county of residence of the person returning to the country.

30. I would like to leave my current home in County X together with my girlfriend and go, with my personal car, to the home address in the bulletin, respectively in County Y, because in County X the number of cases of people who have been confirmed with COVID-19 is much higher compared to the one in Jud. Y. We intend to self-isolate at Y's home with our family. Can we make this trip?

răspuns: Military Ordinance number 3 does not stipulate that citizens must stay at their home address, but at a location indicated by them, in compliance with the legal provisions and the imposed restrictions. Thus, we specify that it is also allowed to travel with the family to another area, if the people own a house there that offers them better conditions, in order to stay in that locality.

31. I am a doctor, I am over 65 years old, active and I work 8-14, so I have no way to purchase my strictly necessary products during the oral interval 11-13. How do I proceed in order not to be fined?

răspuns: Compliance with the provisions of the Military Ordinances is mandatory, implicitly the aspects related to the conditions and intervals in which people move during this period. For particular issues whose solution could be influenced by the normative acts issued for this period, we recommend that you seek the support of other people.

32. What reason do you recommend I tick for the following situation: I live in Târgu Mureș, but I am at college in Cluj. Since the schools are closed, I can no longer keep the rent in Cluj and I have to vacate the apartment. I have to travel Târgu Mureș - Cluj and return.

răspuns: In accordance with art. 1, lit. d) from Military Ordinance no. 3 of 24.03.2020 regarding measures to prevent the spread of COVID-19, travel is allowed for justified reasons (vacation of the apartment in the municipality of Cluj Napoca, as the rent can no longer be kept, in your case). It is necessary to complete declarations on your own responsibility, in this sense, both to reach the destination and for the movements in the respective locality, and these will be presented at the request of the competent bodies. If you can provide proof that you rented that home (eg receipts, rental agreement, etc.) that would be great.

33. I live in Vâlcea county, and my father, aged 50, works near Bucharest. The store where he works is about to close, and he has to get home to Vâlcea county, but he doesn't have a car. To get home by public transport, he has to change 5 buses, trams, subways and my opinion is that if he does that, the risk of being infected increases significantly. My question is, can I come from Vâlcea to pick him up by car and return home?

răspuns: The reason for the move is justified. In this sense, the self-responsibility declaration can be completed in relation to the provision of art. 1 letter d) of Military Ordinance no. 3 of 2020. As can be seen, the situations contained in the norm in art. 1 letter d) have an exemplary character, but assume grounds of a certain importance. Such a situation, such as the one presented by you, could be justified, considering that the risk of your father's exposure to infection is greater, the movement from Bucharest to Vâlcea county presupposing the change of several means of public transport, the times of waiting in stations, etc.). Moreover, your father can justify it with the address in the CI, namely the home address, which is in Vâlcea county. It is important that your father also has an affidavit.

34. My mother came from Brașov to Timisoara on 21.03 to help me after the birth, but now she has to return home. Among other things, they need to get the file to enter the allowance payment offered for dental technicians, which cannot be solved remotely. I mention that during the state of emergency, it is the only income he will have. For the return home, my father would come from Brașov to Timisoara to pick her up by car. What documents are needed in order not to be fined by any police filters encountered on the road?

răspuns: The self-responsibility declaration can be completed in relation to the provision of art. 1 letter d) of Military Ordinance no. 3 of 2020. As can be seen, the situations contained in the norm in art. 1 letter d) have an exemplary character, but assume grounds of a certain importance. Such a situation, such as the one presented by you, could be justified, considering that the risk of your mother's exposure to infection would be greater if the journey were made by train, from Timișoara to Brașov, assuming the change of several means of public transport, waiting times in stations, etc. In addition, without solving the situation with the respective file, they would be without income. In addition to the affidavit, it would be advisable for your mother to be able to present documents attesting to her qualification as a dental technician and the need to obtain the file for the payment of the allowance. Your father will have to have declarations on his own responsibility for both Brașov-Timișoara journeys and return.

35. I am originally from Cornu commune, Prahova county. I have been living in Germany for 10 years, having documents proving this. I have family there. The wife is single with 3 children aged 17 years, 6 and 8 months respectively. I came to Romania on March 11 to get a new ID (I lost my wallet in Germany). Please from the bottom of my heart, I want to get home! Can you guide or help me? (Specifically that I came by plane, not by car).

răspuns: In accordance with art. 9, para. 3 of Military Ordinance no. 7 of 04.04.2020: "the suspension of flights performed by economic air operators to France and Germany and from these countries to Romania is extended for a period of 14 days, starting on April 8, 2020". and according to art. 1 of the same normative act.: "the international road transport of people through regular services, special regular services and occasional services in international traffic is suspended, for all trips made by transport operators to Italy, Spain, France, Germany, Austria, Belgium , the Swiss Confederation, the United Kingdom of Great Britain and Northern Ireland, the Kingdom of the Netherlands and Turkey and from these countries to Romania, throughout the state of emergency." 36. I want to know if, being 67 years old, I can travel together with my wife, in my personal car, to her mother, whose health is precarious, she is 88 years old, partially immobilized, etc. Its domicile is in a village in Vâlcea county. This is not a "trip"!

răspuns: As can be seen, the situations contained in the norm in art. 1 of Military Ordinance 4 are exemplary in nature, but they assume grounds of a certain importance. The reason for the move must be a justified one/no delay. A situation like the one presented by you (caring for a person whose health is precarious, partially immobilized) could be justified, by presenting some evidence to attest to what you mentioned vis a vis the illness of your mother-in-law. You and your spouse must complete your own declarations.

37. My father has cancer and is undergoing chemotherapy treatment. I can go to Brăila myself and bring him to Bucharest, and after the completion of the therapy I can take him home, then return to Bucharest alone to my residence. I will have on me: my affidavit, my report card, a copy of his report card, a certificate that he has to do the treatment - all in electronic format, because I have nowhere to print them. Are they enough?
And one more question, can I travel between 22:00 and 06:00? Because in Bucharest we have to be at the clinic around 7:30.
