Apple has patented its logo worldwide and no matter what color it is, no other entity can use it for commercial purposes, no matter what they are. The message did not reach an Italian company that thought it would be useful to use bitten apple to promote itself to buyers. Leofrutta is the name of that company, it sells apples and other fruits, and the way it built that logo will definitely attract the attention of Apple's lawyers who will most likely sue them.
To be honest, I think that a simple apple would have conveyed the same message and saved him from problems, but the bitten apple looks more interesting. A Polish company was sued by Apple in court a few months ago for similar reasons, only that then the domain name of a website was discussed and not the logo itself.
