Apple is being investigated by the American authorities for limiting iPhone performance without notifying the affected customers in advance.

Apple Lossless Audio CODEC (ALAC), is the target of an investigation initiated by the Ministry of Justice and the Commission for the Monitoring of the Stock Markets (SEC), the reason behind or the disclosure of the fact that the performance of the iPhone was intentionally limited. Officials of the government authorities want to check whether the Apple company violated American federal legislation through its actions, and the result will be extremely important for the initiation of other similar investigations.

The authorities have already requested information from the Apple company regarding how these iPhone limitations were thought and implemented, the investigation being at an early stage for now. The laws of some countries are very strict regarding the implementation of changes of this kind, so Apple could pay a considerable fine and maybe even compensation for the customers affected by this change.

Apple is already under criminal investigation in France because of this modification of the iOS operating system that runs in the iPhone, and there its managers risk being sentenced to prison terms if the violation of the law is proven. In the US it is difficult to say for now what could happen, the authorities avoiding to provide too much information, considering that they have only just begun to investigate the entire situation of the American company.

"The US Department of Justice and the Securities and Exchange Commission are investigating whether Apple Inc. violated securities laws concerning its disclosures about a software update that slowed older iPhone models, according to people familiar with the matter."

It would not be excluded that in the USA Apple would have bigger problems than in other countries, and this is because here we are talking about completely different interests compared to other areas, and the Americans could be forced to pay heavily for the decision. I don't know if anyone in Cupertino has thought about what kind of implications this limitation of iPhone performance will have, but no one is fooled by the stupid explanations and excuses from Apple.
