It's official, as of today, Ordinance 11/2019 comes into force, which stipulates that simply holding a phone while driving a car, motorcycle, or riding a bicycle is punishable by higher fines or worse. Extremely important to understand is that youth in hand of the mobile phone will bring the fine, regardless of whether you use it, or just walk it through the air to air it out, it doesn't matter, if you hold it in your hand, take the fine.

The Romanian police explain the fact that youth in hand of the mobile phone when you commit another contravention to the traffic code will bring a much more serious punishment, the loss of the driver's license. In the example above, if until now the failure to give priority to pedestrians was punished with the suspension of the driver's license for 30 days, from now on, if hold the phone in your hand when you don't give priority, you have license suspended 60 days, so double.

"Thus, holding or using with the hands in any way, while driving on public roads a motor vehicle, agricultural or forestry tractor or moving tram, the mobile phone or any mobile device equipped with the function of recording or playing text , photo or video, simultaneously with the violation of a rule for the movement of vehicles, constitutes a misdemeanor and is sanctioned with the fine provided for in the second class of sanctions, from 4 to 5 fine points (from 580 lei to 725 lei ), and with the application of the complementary sanction of suspending the exercise of the right to drive for 30 days."

That's not all because any misdemeanor committed with a phone in hand bring suspension of the carnet for a period of 30 days, and here comes the big problem. According to the new emergency ordinance, yes hold the phone in your hand while driving and you commit one of the following contraventions, but not limited to them, you have card suspended for 30 days :

• "exceeding by 10-20 km/ha the maximum speed allowed on the respective road sector for the category of which the driven vehicle belongs, ascertained, according to the law, with homologated and metrologically verified technical means;
• driving on a road sector where access is prohibited;
• non-compliance with the obligation to use the meeting lights during the day or the lights for daytime traffic, on highways, expressways and on European national roads (E);
• exceeding by 21-30 km/ha the maximum speed allowed on the respective road sector for the category of which the driven vehicle belongs, ascertained, according to the law, with homologated and metrologically verified technical means;
• failure to comply with the rules regarding the turning maneuver, going backwards, changing the traffic lane or the direction of travel, if this resulted in an accident resulting in damage to a vehicle or other material damage;
• failure to keep an appropriate distance from the vehicle in front, if this resulted in an accident resulting in damage to a vehicle or other material damage;
• entering an intersection when traffic inside it is blocked;
• not granting the priority of passage to pedestrians engaged in the regular crossing of the public road through the specially arranged and signposted places, located in the direction of movement of the motor vehicle, the agricultural or forestry tractor or the tram;
• non-compliance with overtaking rules;
• exceeding by 31-40 km/ha the maximum speed allowed on the respective road sector for the category of which the driven vehicle belongs, ascertained, according to the law, with homologated and metrologically verified technical means;
• traffic in the opposite direction, except in cases where the overtaking maneuver is carried out according to regulations;
• exceeding by 41-50 km/ha the maximum speed allowed on the respective road sector for the category of which the driven vehicle belongs, ascertained, according to the law, with homologated and metrologically verified technical means;
• not stopping at the level crossing with the railway when the barriers or semi-barriers are lowered or in the process of being lowered or when the signals with red lights and/or sounds are in operation;
• exceeding by more than 50 km/h the maximum speed allowed on the respective road sector and for the category of which the driven vehicle belongs, ascertained, according to the law, with homologated and metrologically verified technical means."

The examples can continue depending on the contraventions, but according to those from the Romanian Police, almost any contravention you have committed when you hold the phone in your hand, you automatically lose your card if you are seen by a traffic officer. Very important to remember is that if you have the phone in a car holder and use it, then the penalties apply exactly the same as if you had the phone in your hand.
