Competition Council: 460.000 EURO FINE for a Telecom Operator

The Competition Council fines netcity

A telecommunications operator from Romania was fined 460.000 euros by the authorities, a very large one for our country, but it comes after a long analysis made by the Romanian authorities.

The Competition Council applied this fine to those from Netcity Telecom for abuse of dominant position, the company creating the underground cable network of Bucharest, in which all operators should move their current cables.

The fine was applied by the Competition Council because in the period 2010-2019 the Netcity company would have abused its dominant position and imposed unfair conditions for telecom operators in Bucharest.

Netcity would have applied pricing conditions dependent on the degree of occupation of a functional loop within the network, and obliging customers to contract minimum lengths of infrastructure - support from the Romanian company, all inhibiting competition.

"As we have said on other occasions, we do not dispute the utility of the project, which aims both to increase the quality of data transmission services and to improve the visual appearance of the city, but the competition rules must be respected. During the same investigation, the Competition Council found that, in the period 26.11.2013 - 26.10.2016, the administration of the Municipality of Bucharest, through the Mayor General and the General Council of the Municipality of Bucharest, did not take the necessary steps in the process of regulating the conditions of access to the infrastructure Netcity.”

The reaction of those from Netcity for the received fine came very quickly, and is as follows:

"Regarding the investigation of the Competition Council, Netcity reconfirms and maintains its role of providing residents, businesses and telecommunications operators in Bucharest with a modern, secure and accessible infrastructure. The company has taken note of the information issued by the Competition Council and is waiting for the drafting and publication of the authority's decision to be able to establish, fully respecting the legal framework, the next steps."
