The coronavirus brings a series of new emergency measures to Romania, at this moment military ordinance 3 is being presented, the one on which the Romanian Government has been working in recent days to prevent the further spread of the virus in our country.

Some of today's official statements regarding military ordinance 3 have created a bit of confusion among people, but now the decisions are coming in their final form, so we have a 100% clear picture of what is required in all of Romania due to the Coronavirus .

The new measures from military ordinance 3 are:

"Art. 1. – The movement of all persons outside the home/household is prohibited, with the following exceptions:

a) travel in professional interest, including between home / household and the place / places of professional activity and back;

b) traveling for the provision of goods that cover the basic needs of people and pets/domestic animals, as well as goods necessary for carrying out professional activity;

c) travel for medical assistance that cannot be postponed or carried out remotely;

d) travel for justified reasons, such as child care/accompanying, assistance to elderly, sick or disabled persons or death of a family member;

e) short journeys, near the home/household, related to the individual physical activity of people (excluding any team sports activities), as well as for the needs of pets/domestic animals;

f) travel for the purpose of donating blood, to blood transfusion centers;

g) traveling for humanitarian or voluntary purposes;

h) traveling to carry out agricultural activities;

i) the movement of agricultural producers for the marketing of agri-food products.

Art. 2. - The circulation of persons who have reached the age of 65, outside the home/household, is allowed only between 11.00 and 13.00, strictly for the following reasons:

a) travel for the provision of goods that cover the basic needs of people and pets/domestic animals;

b) travel for medical assistance that cannot be postponed or carried out remotely;

c) moving for justified reasons, such as caring for/accompanying a minor, assisting other elderly, sick or disabled persons, or in the event of the death of a family member;

d) short journeys, near the home/household, related to the individual physical activity of people (excluding any collective physical activities), as well as for the needs of pets/domestic animals.

Art. 3. – The circulation of the persons provided for in art. 2, outside the home/household, it is also allowed outside the time interval 11.00 - 13.00, if it is done in professional interest or for carrying out agricultural activities.

Art. 4. – (1) To verify the reason for the travel:

a) employees present their work ID card or certificate issued by the employer;

b) authorized natural persons, owners of individual enterprises, members of family enterprises, freelancers and persons practicing agricultural activities present a declaration on their own responsibility, completed in advance.

(2) To verify the reason for travel in situations other than those provided for in paragraph (1), a self-responsibility declaration, filled in beforehand, must be presented.

(3) The affidavit must include the name and surname, date of birth, home address, reason and place of travel, date and signature.

(4) The certificate issued by the employer or the affidavit can be presented to the staff of the competent authorities also by means of the telephone, tablet or a similar electronic device.

(5) The measure applies starting from March 25, 2020, 12.00:XNUMX p.m.

Art. 5. – (1) The measure of isolation at home or, as the case may be, quarantine is instituted for all persons entering Romania.

Art. 6. – (1) Local public administration authorities have the obligation to identify and keep records of homeless people, as well as to ensure their shelter and care.

(2) The record of homeless persons is updated and reported weekly to the Bucharest County/City Center for coordination and management of the intervention.

(3) The measure applies starting from the date of publication of this military ordinance in the Official Monitor of Romania, Part I.

Art. 7. – (1) Public institutions and economic operators have the obligation to mark the area intended for citizen/customer access and the public relations/sales area with visible signs to guide people in observing a safety distance of at least 1,5 meters.

(2) Administrators of agro-food markets have the obligation to organize the sales activity in such a way as to maintain a social distance between agricultural producers, traders and buyers. Traders and agricultural producers located in agri-food markets are obliged to adopt protective measures against the spread of COVID-19, namely to wear gloves and masks.

(3) The measure applies starting from the date of publication of this military ordinance in the Official Monitor of Romania, Part I.

Art. 8. - All flights by air operators to France and Germany and from France and Germany to Romania are suspended for all airports in Romania for a period of 14 days.

(2) The measure does not apply to flights made with state aircraft, freight and mail, humanitarian or emergency medical services, as well as non-commercial technical authorizations.

(3) The measure shall be applied from March 25, 2020, at 23.00, the time of Romania.

Art. 9. – (1) The access of pilots on board the ships, arriving from the red/yellow risk zones in the Romanian seaports, is prohibited, if they do not have the protective equipment established by the Constanța Public Health Directorate or if the ships have not completed the period of 14-day quarantine from the last port of call located in a red/yellow risk zone.

(2) The access of maritime and fluvio-maritime vessels to the ports located on the maritime Danube is prohibited, until the quarantine period of 14 days has been completed from the last port of call located in a red/yellow area, in the following two docking areas in anchor:

a) Sulina harbor road, for ships coming from the Black Sea;

b) Danube, nautical mile 44, for ships coming from the Bâstroe channel.

(3) The measure applies starting from the date of publication of this military ordinance in the Official Monitor of Romania, Part I.

Art. 10. – The Ministry of National Defense ensures, at the request of the Minister of Internal Affairs:

a) the taking over of some objectives whose protection is currently ensured by the Romanian Gendarmerie;

b) personnel and logistical means to support public order activities;

c) personnel and logistical means to support the activities of the Romanian Border Police, at the state border crossing points.

Art. 11. – In order to verify compliance with the conditions of quarantine or isolation at home, the national security institutions will design communication systems and computer applications, necessary for the Ministry of Internal Affairs, the Ministry of Health and local authorities, to communicate in real time and permanently with the persons quarantined or isolated at home.

Art. 12. – (1) Documents that expire during the state of emergency, issued by the public authorities, can be changed within 90 days from the date the state of emergency ends.

Art. 13. – (1) According to paragraph (2) of article 2 of Military Ordinance no. 2/2020 regarding measures to prevent the spread of COVID-19, published in the Official Gazette of Romania, Part I, no. 232 of March 21 2020, a new paragraph is introduced, paragraph (21), with reference to activities allowed in shopping centers, with the following content:

"(21) The temporary suspension of commercial activity according to paragraph (1) does not apply:

a) the sale of electronic and household electrical products by economic operators who ensure delivery to the buyer's home/office;

b) the sale of medical optics products and services."

(2) The measures provided for in paragraph (1) apply starting from the date of publication of this military ordinance in the Official Gazette of Romania, Part I.

Art. 14. – (1) They are empowered to ensure the application and compliance with the provisions of this military ordinance:

a) The Romanian Police, the Romanian Gendarmerie and the local police for the measures provided for in art. 1 – 4;

b) The Romanian Police, the Romanian Gendarmerie, the local police, the General Inspectorate for Emergency Situations and the subordinate structures, the public health directorates and the leaders of the local public administration authorities, for the measure provided for in art. 5;

c) The Romanian Police, the Romanian Gendarmerie, the local Police, the National Fiscal Administration Agency, the National Authority for Consumer Protection and the leaders of the local public administration authorities, for the measure provided for in art. 7;

d) Ministry of Transport, Infrastructure and Communications, for the measure provided for in art. 8;

e) The Romanian Naval Authority and the public health departments, for the measure provided for in art.9.

(2) Failure to comply with the measures provided for in art. 1 – 5, art. 7 – 9 attract disciplinary, civil, contraventional or criminal liability, in accordance with the provisions of art. 27 of the Government Emergency Ordinance no. 1/1999, with subsequent amendments and additions.

(3) The staff of the institutions referred to in paragraph (1) is empowered to ascertain contraventions and apply sanctions, in accordance with the provisions of art. 29 of the Government Emergency Ordinance no. 1/1999, with subsequent amendments and additions.

Art. 15. – (1) This military ordinance is published in the Official Gazette of Romania, Part I.

(2) The provisions of art. 4 and 5 of Military Ordinance no. 2/2020 cease to apply.

(3) Audiovisual media service providers have the obligation to inform the public, through regularly broadcast messages, for at least 2 days from the date of publication, about the content of this military ordinance."
