Astazi compania Apple a obtinut o victorie importanta intr-o instanta din Shanghai care a dat o hotarare impotriva companiei Proview care cerea interzicerea vanzarii tabletei iPad in respectiva regiune din China. Apple poate vinde in continuare tableta iPad fara probleme in China si acum asteapta rezultatul unui apel formulat la o instanta din Guangdong, instanta care in decembrie a hotarat ca tabletele iPad sa fie scoase din magazine. Cei de la Proview vor face apel impotriva hotararii de astazi insa in spatele povestii se afla interese mult mai mari.
Proview had sought the injunction, saying it owns the iPad trademark in China. Apple, which contends that it previously purchased the rights to the iPad name from Proview, had applied in Shanghai to suspend proceedings on Wednesday. Ma Dongxiao, an attorney representing Proview, said the company doesn’t yet have a response. Right now, the most valuable asset of Proview Group is the iPad trademark registration in China. Assuming the creditors have control of the affairs of Proview Shenzhen, it might be in their best interest to get a settlement as quickly as possible to monetize the Proview assets.
Banca Minsheng si cea a Chinei detin pachetul majoritar al activelor Proview si oficialii companiei nu pot incheia niciun fel de intelegere fara acordul bancilor deci practic Apple trebuie sa negocieze cu ambele banci o eventuala terminare a disputei. Unul dintre avocatii companiei Proview a declarat ca o intelegere intre cele doua companii este in continuare posibila desi deocamdata Apple lupta pentru protejarea brandului sau in China. Pentru moment cei de la Apple rasufla usurati insa nu se stie ce le va aduce viitorul.
