Apple requests a ban on the sale of the Samsung Galaxy Tab 10.1 in the US

  Because he was successful in imposing his will against those from HTC, Apple requested now a court to ban the sale of the Samsung Galaxy Tab 10.1 tablet in the USA. Apple's request comes just 4 days after another court decided that an iPad patent is valid, so Apple is now trying to enforce it against Samsung. Apple asked an American court to decide without hearing its own lawyers or those of Samsung, and there is a good chance that this request will be accepted.

At 8 PM local California time on Friday, Apple filed a motion for a US preliminary injunction against Samsung's Galaxy Tab 10.1. The motion is based on a ruling by the Court of Appeals for the Federal Circuit (CAFC), which came down four days earlier and sided with Apple on the question of whether an iPad-related design patent (US Patent No. D504,889) is likely valid. It also comes only three calendar days before the two companies' CEOs and chief lawyers will hold court-moderated settlement talks in San Francisco. Apple's motion is fairly likely to succeed. If and when it does, there will be formal US bans in place against all three of the leading Android device makers.

  If Apple obtains the ban, then it could be used not only against those from Samsung, but also against other tablet manufacturers. Last year, Apple managed to obtain a ban on the sale of the Samsung Galazy Tab 10.1 in Germany, and now it seems that the same thing could happen even in the USA.
