National Authority for Communications Administration and Regulation draws the attention of users who own or purchase telephone and internet services within offers presented as having "unlimited" benefits that telecom operators may impose limits on the use of minutes, SMS or data provided in the offers, exceeding them may lead to access restriction to the respective services or even to additional costs.
It is good for users to be aware that telecom operators' offers advertised as having "unlimited" benefits often contain restrictions or conditions of use in order to prevent fraud or misuse of the voice or data services marketed by the providers. Operators are obliged to include information about possible applicable restrictions in contracts concluded with end users, both in the case of subscriptions and in the case of prepaid cards.
For example, to reduce the risk of fraud, operators can restrict or interrupt access to the telephone service for users who exceed a monthly consumption considered reasonable, contractually detailed through certain thresholds (for example, monthly calls of more than 5.000 minutes). Also, operators can limit contractual benefits in situations where the monthly voice traffic outside the network is much higher than the voice traffic received outside the network, or they can reduce data transfer speeds after consuming a certain amount of traffic of data (eg 5 GB).
In addition, to avoid abusive use, operators can specify in the contract that the services offered can only be used for the users' own needs and not for testing equipment, reselling the service to third parties or using automated systems for sending SMS in bulk, making calls or transferring data for the purpose of obtaining profit in a commercial activity.
In situations where users do not comply with the contractual conditions, the providers can suspend or restrict the services offered, for example by blocking the initiation of calls until the end of the billing month (except for emergency calls), can unilaterally terminate the contracts in force or apply penalties or request compensation from customers.
ANCOM advises users to carefully review the contractual conditions when purchasing telephone and internet services with unlimited benefits, in order to avoid such situations generated by ignorance of usage restrictions.
