RCS & RDS. Telekom, Orange, Vodafone, are part of a very important change announced by the Romanian Government, and this also has an impact on the customers who use their services in the country. GEO 114/2018 introduced a change based on which operators were liable to a special fine if they did any construction, or other works, in areas where they did not have the right of access, or construction authorization, RCS & RDS, and the other operators could receive large fines.
RCS & RDS. This provision of GEO 114/2018 was accused by the operators as a violation of the Romanian Constitution, and they threatened to challenge it in the Constitutional Court if it remains in force. In order not to risk losing at the Constitutional Court, the Government of Romania decided to change its application, so that RCS & RDS, and the rest of the telecom environment, will not have it applied against them until September 1, 2019, during which time it will probably be modified .

RCS & RDS. Until then, the operators should solve any kind of problems due to which they could have received a special fine starting on April 1, when the provisions of this emergency ordinance would come into force. RCS & RDS did not complain about the existence of this provision in GEO 114/2018, but Orange, Vodafone, Telekom did, and the Romanian Government gave in to the demands made by the companies, but this is not the only concession made.
RCS & RDS. Another change concerns the unauthorized use of radio frequencies in Romania, with operators to be fined 0.1% of the previous year's turnover for each day of violation. For now, there is no risk that any license will expire for RCS & RDS, or other operators, but if this happens, and some will use the frequencies without the right, then they will face substantial fines from ANCOM starting in 2019 .
RCS & RDS. Apart from these changes, others should be made to reduce license prices for 5G frequencies, but also to eliminate the new turnover tax that the Government wants to impose.
