Minister of Health New EMERGENCY Ordinance of the Government Changes All Romania

The Minister of Health officially announces a new emergency ordinance that the Government of Romania intends to adopt in order to implement a series of very important changes for the medical system in Romania, and this is because it concerns the vacation leave that is granted to the medical staff in the country .

The Minister of Health talks below about the way in which the granting of vacation leave is facilitated for Romanians throughout the country at the current time, and this is because we are talking about measures designed to help people benefit from what they need in terms of days free, after a lot of work.

"It is proposed to supplement Law no. 95/2006 on health reform, republished, with subsequent amendments and additions, so that contractual staff in the public health system can benefit from annual leave of up to 38 working days, depending on seniority, calculated in accordance with the provisions of the collective labor agreement at the level of the Health budget sector.

At the same time, in order to facilitate the employment of jobs in the health system, it is proposed that in the situation where the health unit that resumes or expands its activity within a period of 12 months from taking measures to terminate the individual employment contract as a result of layoffs collectives, to have the obligation to rehire with priority on the re-established position in the same activity, the fired employees, without examination, competition or trial period, if they meet the conditions required by law for the occupation of these vacant positions.

Considering the procedure provided by law for the establishment of a public hospital, the 12-month term proposed for the re-employment of staff in the situation where a public health unit resumes its activity, i.e. is established, is a term that will fully cover the completion of all the procedures provided for by law . Taking into account the particular situation of medicines with "medicinal gas" as their pharmaceutical form, the exemption from the approval by order of the Minister of Health of the maximum prices of the medicines in question is required.

The prices of these medicines are to be set freely and will be brought to the attention of the Ministry of Health by the holders of marketing authorizations in order to publish them in the National Catalog of the Prices of Medicines for Human Use (CANAMED), to be sold to the health units with beds from the public system and ambulance services following public procurement according to the legal provisions in force.

Regarding Law no. 98/2016 on public procurement, with subsequent amendments and additions and GD 395/2016 for the approval of the Methodological Norms for the application of the provisions relating to the awarding of the public procurement contract/framework agreement from Law no. 98/2016 on public procurement, by participating in public procurement procedures (open tender, simplified procedure, negotiation without prior publication of a tender notice) and also through direct procurement completed in the Electronic Public Procurement System."
