Samsung wins an appeal against the decision to ban the Samsung Galaxy Nexus in the US

In the USA, Samsung's lawyers were very active and fought against the decisions by which the Samsung Galaxy Tab 10.1 and Galaxy Nexus were banned from sale. For the time being, those from Samsung have not managed to suspend that order for the tablet, but in the case of the Samsung Galaxy Nexus obtained a temporary suspension of the sale prohibition order. The court's decision gives Samsung the opportunity to sell the Galaxy Nexus in the US until a federal court decides whether the terminal can be sold during an appeal in another process, or it will be completely removed from stores.

Good news for Samsung and Google: late in the day on Friday, the United States Court of Appeals for the Federal Circuit issued an order granting Samsung's motion for an immediate, temporary stay of Apple's preliminary injunction against the Galaxy Nexus smartphone. The stay relates to the period of time between now and the Federal Circuit's decision on Samsung's motion to stay the Nexus injunction for the entire duration of the appeal. As I reported earlier, Apple has until Thursday (July 12) to respond to the motion to stay. The court will await Apple's response and then decide on a stay for the entire duration of the appeal.

The victory of Samsung comes just a few days after Google has pulled the Galaxy Nexus from its store to implement some software changes intended to remove the technologies for which Apple requested the ban. Of course, the victory is temporary and Google should not give up the plan to modify the software, but as soon as it does, that patent invoked by Apple will be useless in this process. In conclusion, Samsung wins an important battle against Apple, it remains to be seen what effect it will have in the long term.
